What do you think is the current law in the UK about using mobile phones whilst driving?

The law is changing on February 27 but what do understand to be the current restrictions and penalties? Can you text but not talk? Can you use a hands-free? Do you just get a telling off?


You may use as long as it is not held, but you must keep control of vehicle. Fines are £30 fixed penalty up to £1k more if bus or hgv.

Not a law, but common sense: when you're driving don't fiddle with unecessary items like phones. You're driving can affect more (like someone's life) than a phone call.

hands free only £30 fine if caught

From what I've heard, the new law on using mobile phones whilst driving could result in a £60 fixed penalty fine, plus 3 points on your license. Just holding the phone up to your ear, where it might be seen by a copper, is probably all that it takes to get nicked! Don't even think about doing it. As for texting, which requires 'eyes down look in', this is even more effin dangerous. The best trick while driving is to keep an eye on the road ahead as far as you can possibly see, while at the same time keep glancing in all of your mirrors. By doing this, you'll know if its safe to use the mobile phone.

The best thing is not to use one whilst driving. Then you can not be wrong.

Can I still use an hands free. can the phone be held to my ear by someone in the passenger seat

the law should impose an 3 month bad on using mobile phone while driving i use a mobile with a hands free kit if they are caught the second time it should be a 12 month ban

I don't drive but i think Mobile phones should be turned off when you're driving unless you are in an emergency situation it's too dangerous to try to concentrate on the road and the phone at the same time

I understood from the Daily Telegraph that hands-free is against the law too, but no doubt you would only be prosecuted for this if you caused an accident.

On country lanes now a new hazard is to round a corner and almost collide with car pulled over because someone is on the phone. I think an awful lot of drivers need a freshener course on safe and unsafe parking.

The way I see the law at the moment it is illegal to use a mobile phone at all while driving unless you have a handsfree set.

However I see lots of people using their phones and I think if you were to get caught doing it you would just get a telling off.

You will not get a telling off. The warning period expired a year ago. These days they nearly always prosecute. (£60 + 3 points)

If you text whilst driving you are extremely irresponsible and should have your car crushed with you and your phone in it.

Yes we all know it's illegal to use a mobile phone & text while driving(I see it every day-i'm a bus driver) BUT who is policing our roads to catch these people? Cameras don't do it.What about drivers who drive with one arm out of the window,they are NOT in control of their vehicle one handed.Until we get MORE police OUT of the office(doing paperwork) & ONTO the streets catching the wrongdoer,NOTHING will change,even with the threat of points on your licence & higher fines, because there is NOBODY out there to enforce the law.

You can receive calls on a hands free, you can not make calls though. There are some sets that let you scroll through your phone book via blue tooth but it still diverts your attention away from the road.

the sooner we brits avoid going the way of the north americans(i.e. yanks) the better - cars are for driving in concentrate on driving not using it as an entertainment media centre. The law is correct stiffer penalties for mobile phone users whilst driving ban em all i say. Hi mum i am going to be five mins late...... smash bang amputated limbs death all for the sake of phoning mum bull **** treat using mobile phones in cars just like drink driving lock em up - these bug*ers are sobre and risking other peoples lives at least the drunk bug*ers don't know what they are doing half the time lock em all up!

I think that this new law sucks. Drivers should be assessed on their individual skill and be determined whether they are allowed to use a mobile or not. The reason i say this is due to the amount of times i have been in near misses caused by bad driving skills (mainly women and old men in hats & leather driving gloves) far out numbers the amount of times the amount of times if any caused by people on mobiles.

I personally don't use my hand held but my hands free and its not down to a safety choice but the fact the nanny state we live in deciding that i am not skilled enough to drive and speak at the same time then fine me.

I agree with anti-smoking and driving argument. speaking as a nonsmoker i don't know, but doesn't every puff give some sort of 'high' which cant be good for driving.

And all this this guff about two hands on the wheel at all times. How the hell do you change gear unless you drive an automatic?

As for a blue-tooth headset. I'm not gonna go out looking like an extra from some star trek episode.

You can't use a phone if you have to hold it in your hand. So..if you have a hands-free unit you are ok. Any sort will do, wireless or wired; the important thing is you don't hold the phone in your hand. Therefore texting is out also.

The upcoming changes are to the penalty, not the offence. Doubled to £60 and points on your licence. 3 I think.

i have no idea,i don't use my phone at all while driving. But i see many people doing it. It doesn't matter what the laws and restrictions are if no-one's watching you.

Keep it simple.

No use of mobiles whilst driving at all - either hand held, hands free or texting. Minimum of 6 points plus £500 fine for those who do.

People managed perfectly well without them before they became commonplace.

It doesn't matter what the law is, so long as our government believes that all accidents are caused by speeding and that cameras rather than trained traffic cops are the way to police our roads, and that motorists breaking the laws are an easy source of revenue rather than someone whose behaviour needs to be intelligently corrected. Speed cameras cannot detect drivers using mobile phones. Fines alienate rather than teach.

We need more police officers patrolling our roads (sitting in a speed camera van does not constitute patrolling). Then the laws on phone, seatbelts, foglamps, defective lighting, etc. will matter, and our roads will be a much safer place.

I understand that the law is the following:

You are not allowed to use your phone in the car unless it is on handsfree, and you cannot text as it requires you to hold the phone and clearly you cannot look at the road if you are texting.

You will be fined £80 and be given 3 penalty points if you are found using your mobile phone in your hand.

I am fed up with seeing really dangerous driving due to fools holding their mobiles to their ears whilst trying to steer and change gear, so I hope the addition of the 3 penalty points makes them think twice about it.

I personally use a blue-tooth hands free and have set up the people I phone often with voice recognition so all i need to do is press a button and speak the name.

To the new law I say bring it on!!! If I can get myself set up for the sake of 20 - 30 quid and I can still control my car!!!

ha.. seems to me most people dont know there is a law against it, i mean how many people do you see, in a day holding a phone with their right hand to their left ear.... madness..

and in answer to your q.. i think its a good idea, altho a £60 fine.

my 15 yr old got a £30fine for cycling on a pavement.. where is the justice eh??

At the moment the law states that you cannot use a mobile phone whether hands free or hand held while the vehicle is in motion ~ the fine is a minimum of £30 raising to a maximum of £1000 for car drivers or a maximum of £2500 for van, lorry, bus and coach drivers.

this is definately not enough as I saw a young child killed on a pedrestrian crossing by a woman using a mobile phone, it should be a minimum of £100 and 6 points on the person's licence and if caught a second time an automatic ban, that would might make people think twice before using it.

Yes I do have a mobile phone and no I don't use while I'm driving, if it rings I wait until I'm home then ring them back and I always tell people that I don't answer my mobile when I'm driving.

the law until 27th feb is that you will get a slap on the wrists for the first time and a fine,

as of 27th feb you will get fined and 3 points on your license. but to be honest i think it should be a bannable offense because it is driving without due care and attention. the amount of people that i have seen on their phone with one hand and cigarrette in the other, they should be instant ban because how are they supposed to concentrate on the road?

the hands free has to be blue tooth and have no connecting wires as it stands right now.

under no circumstances can you text whilst driving. unless you are totally stopped and i don't mean at traffic lights. with engine off.

You can use a hands-free but if they catch you talking with phone in one hand and driving with one hand...You could be fined.
