I would think a master's level degree would be sufficient for patent law. I had a friend in law school with a master's degree in engineering who went into patent law and did quite well for herself. I think it's more important to go to a good law school, other things being equal, than to have a Ph.D.

the law degree will get you the same thing. skip the PhD in chemistry--you'll just be throwing away money. you know what you need to about chemistry already if you are working on a PhD right now.
